By accessing or using our Services, including browsing our website and making any rental, purchase, or reservation, you agree to be bound by these Terms of Service, our Privacy Policy, and any other documents incorporated herein.

1. Agreement to Terms: By using the Services, you affirm that you have read, understood, and agree to comply with these Terms of Service. If you disagree with these Terms, you are prohibited from using our Services and must discontinue use immediately. We may update these Terms at any time, and we will notify you of any changes by posting the new terms on our website. Your continued use of our Services after such updates constitutes your acceptance of the revised terms.

2. General Terms Our Services include the rental of decor items, event supplies, and related services (collectively, “Products”). We reserve the right to limit, modify, or discontinue any portion of our Services at our sole discretion, including but not limited to product availability and delivery zones. You agree to provide accurate and up-to-date information during the rental process and agree to be responsible for the use of the Services.

3. Product Rentals, Deliveries, and Returns

• Rental Reservations: Rentals can be reserved up to 1 day before the requested delivery date. Reservations made within 1 day are not guaranteed unless confirmed by us. All rental requests are subject to availability.

• Rental Fees: A rental fee may include product rental charges, a security deposit, and delivery charges. Payment is required at the time of reservation. You authorize us to charge your selected payment method for the rental and any associated fees.

• Delivery and Return: You agree to use the repacking materials and follow the return instructions provided. Products must be available for pickup/drop-off at the designated location on the return date. If the product is not returned as agreed, you authorize us to charge a non-refundable late fee, calculated based on the rental value of the product(s).

• Damage to Products: You are responsible for the care of the products. Any damage beyond normal wear and tear will result in a charge equal to the replacement or repair cost of the damaged product(s), up to the full retail value.

4. Cancellations

• Full Refund: Cancellations made up to 7 days before the scheduled delivery date will receive a full refund.

• Partial Refund: Cancellations made within 3 days are subject to a 50% cancellation fee.

5. Sales of Products

• Final Sales: Products purchased from us are sold as-is, and all sales are final. No returns or exchanges are permitted except where required by law.

• No Warranty: We make no warranties, express or implied, regarding the products and are not liable for any damages or issues arising from the use of the purchased items.

6. Use of Products: You agree to treat all rented decor and products with care. Normal wear and tear is expected, but you will be charged for any damage beyond what is considered reasonable by us. Minor damage, such as light scratches or stains, will not incur an additional charge, but you are responsible for more significant damages.

7. Gift Cards

• Purchase and Use: The purchase and use of gift cards are subject to these Terms of Service. Gift cards are non-refundable and cannot be redeemed for cash except where required by law.

• Expiration: Gift cards may be subject to expiration as determined by applicable law.

8. Prohibited Uses By using the Services, you agree not to engage in any of the following activities:

• Use the Services for illegal or unauthorized purposes.

• Engage in data mining, scraping, or other automated collection of information from our website.

• Use our website or Services in a manner that disrupts, damages, or impairs the functioning of our systems.

9. User Representations and Warranties By using our Services, you represent and warrant that:

11. Limitation of Liability To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, or consequential damages arising out of or related to the use of our Services or products, including any loss of profit, data, or business.

12. Indemnification You agree to indemnify and hold harmless lemonayde.com and its employees, agents, and affiliates from any claims, damages, or expenses arising out of your use of our Services, including but not limited to any breach of these Terms.

13. Dispute Resolution Any disputes arising out of or related to these Terms shall be resolved through binding arbitration in accordance with the rules of the Arbitrators Association of British Columbia, and you consent to the exclusive jurisdiction and venue in BC.

• Governing Law: These Terms shall be governed by and construed in accordance with the laws of BC, without regard to its conflict of law principles.

• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

• Entire Agreement: These Terms represent the entire agreement between you and lemonayde.com and supersede all prior agreements and understandings.
